1. Introduction & Acceptance of Terms

In plain language: By using our website or services, you agree to these Terms. Please read them carefully before proceeding.

Welcome to safetysavvyco.com (“Company,” “we,” “us,” or “our”), a pottery studio safety education company based in Pennsylvania. These Terms of Service (“Terms,” “Agreement”) govern your access to and use of the safetysavvyco.com website, including all associated subdomains, digital platforms, online courses, downloadable materials, assessments, memberships, and consulting services (collectively, the “Platform”).

By accessing or using any portion of the Platform — whether by browsing the website, creating a user account, enrolling in a membership, completing a studio safety assessment, downloading a resource, or engaging our consulting services — you (“User,” “you,” or “your”) acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you are accessing or using the Platform on behalf of a business, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In that case, “you” and “your” shall refer to both you individually and that entity.

If you do not agree to these Terms in their entirety, you must immediately cease all use of the Platform and refrain from accessing any safetysavvyco.com services.

These Terms are effective as of October 3, 2026, and supersede all prior agreements, representations, or understandings between you and safetysavvyco.com regarding your use of the Platform.

3. User Accounts & Registration

In plain language: You are responsible for your account credentials and all activity under your account. Keep your password secure. Accounts are for adults 18 and over.

Access to certain features of the Platform, including membership content, assessment results, and downloadable resource libraries, requires the creation of a User Account. By registering for an account, you agree to the following:

  1. Accurate Information: All registration information you provide — including your name, email address, and billing details — is truthful, accurate, current, and complete, and you will promptly update it if it changes.
  2. Account Security: You are solely responsible for maintaining the confidentiality of your account credentials. Do not share your login with any third party, and notify us immediately of any unauthorized use at safetysavvyco@outlook.com.

7. Disclaimers & Limitation of Liability

In plain language: Our content is educational — it doesn’t replace professional safety advice and can’t guarantee outcomes. Our legal liability is limited.

7.1 Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES, CONTENT, AND MATERIALS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Safety education content on this Platform is for general educational and informational purposes only. It does not constitute legal advice, regulatory guidance, or professional industrial-hygiene services, and does not guarantee regulatory compliance or the prevention of injuries or incidents. You are solely responsible for ensuring your studio practices comply with all applicable laws and regulations.

7.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAFETY SAVVY CO., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, PERSONAL INJURY, OR REGULATORY FINES — ARISING FROM YOUR USE OF THE PLATFORM, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

Some jurisdictions do not allow certain warranty or liability limitations; if you live in one, some limitations above may not apply to you.

8. Indemnification

In plain language: If your misuse of our Platform causes legal trouble for us, you agree to cover our costs.

You agree to indemnify, defend, and hold harmless Safety Savvy Co. and its officers, directors, employees, agents, and service providers from claims, damages, losses, costs, and fees (including reasonable attorneys’ fees) arising from: your use of the Platform; your violation of these Terms or any law; content you submit; or misrepresentations you make in connection with your account.

We reserve the right to assume exclusive defense of any indemnified matter at your expense, and you agree to cooperate. You will not settle an indemnifiable claim without our prior written consent.

9. Third-Party Links & Services

In plain language: We may link to outside sites or use third-party tools. We aren’t responsible for them.

The Platform may link to third-party websites or use third-party services (for example, payment processors, video hosting, or email tools) that we do not control. We assume no responsibility for their content, privacy practices, or availability, and a link does not imply our endorsement. Review the terms and privacy policies of any third-party site you visit.

10. Privacy Policy Reference

In plain language: Our Privacy Policy explains what data we collect and how we use it.

How we collect, use, store, and share personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Direct any privacy questions to safetysavvyco@outlook.com.

11. Termination

In plain language: Either side can end this agreement. We may suspend accounts that break the rules. Some provisions survive termination.

11.1 Termination by You

You may terminate your account at any time by emailing safetysavvyco@outlook.com. Termination does not entitle you to a refund except as provided in Section 6 or required by law.

11.2 Termination or Suspension by Safety Savvy Co.

We may suspend, restrict, or terminate your access at our sole discretion, with or without notice, for reasons including breach of these Terms, fraudulent or abusive activity, failure to pay fees, or legal requirements.

11.3 Effect of Termination

On termination: your license to use the Platform ends immediately; you must stop using the Platform and its content; we may delete your account data per our Privacy Policy; and provisions that by nature should survive — including Sections 4, 7, 8, and 12 — remain in force.

12. Governing Law & Dispute Resolution

In plain language: Pennsylvania law applies. We ask that disputes go through informal resolution first, then binding arbitration — not class actions.

12.1 Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.

12.2 Informal Resolution

Before starting any formal proceeding, contact us at safetysavvyco@outlook.com describing the dispute and the relief you seek. We’ll make a good-faith effort to resolve it within thirty (30) days.

12.3 Binding Arbitration

Unresolved disputes shall be submitted to binding arbitration administered by the American Arbitration Association under its applicable Consumer or Commercial Arbitration Rules, conducted in Pennsylvania or, at your election, by telephone or videoconference. The arbitrator’s decision is final and binding.

12.4 Class Action Waiver

YOU AND SAFETY SAVVY CO. AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. You waive the right to participate in a class action lawsuit or class-wide arbitration.

12.5 Jurisdiction and Venue

For disputes not subject to arbitration, or to seek emergency injunctive relief, you submit to the exclusive jurisdiction of the state and federal courts located in Dauphin County, Pennsylvania.

13. Changes to These Terms

In plain language: We may update these Terms. We’ll flag material changes, and continued use means you accept them.

We may modify these Terms at any time. We will update the “Last Updated” date above, display a notice on the Platform, and — for material changes — email the address associated with your account. Continued use after the effective date of revised Terms constitutes acceptance. If you don’t agree, discontinue use and cancel your account or subscription.
